Welcome to ZimNGOs.Org (“we,” “us,” or “our”). By accessing or using our website zimngos.org (the “Site”) or our services (the “Services”), including job postings, job searching, and related features, you agree to comply with these Terms & Conditions (“Terms”). If you do not agree, please do not use our Site or Services.

These Terms govern your access and use of the Site and Services. They incorporate our Privacy Policy by reference. We may update these Terms at any time, with changes effective upon posting on this page. Continued use after updates means acceptance. Significant changes will be notified via email to registered users or a prominent Site notice.

Note: This agreement complies with Zimbabwean law, including the Electronic Communications and Transactions Act [Chapter 20:30] (“ECTA”), the Consumer Protection Act [Chapter 14:24], the Data Protection Act [Chapter 12:28] of 2021 (“DPA”), and the Labour Act [Chapter 28:01].

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Reviews or ratings must be based on genuine experiences; we may moderate or remove violations.

3. Content & Intellectual Property

  • Our Content: All content on the Site (text, graphics, logos, images, software) is owned by ZimNGOs.Org or its licensors and protected by Zimbabwean and international intellectual property laws (e.g., Copyright and Neighbouring Rights Act [Chapter 26:05]).
  • Your Use: You may not use our content for commercial purposes without our written permission.
  • Your Content: By submitting content (e.g., job applications, resumes, reviews, messages), you grant ZimNGOs.Org a worldwide, perpetual, non-exclusive, royalty-free license to use, display, reproduce, and distribute it for operating, promoting, and improving the Site and Services. This includes user-generated reviews or ratings, for which you remain responsible.
  • Responsibility: You must ensure your content does not infringe third-party rights (e.g., no defamatory reviews or copyrighted materials). We are not liable for user content but may remove it at our discretion.

4. Payments & Fees

  • Fees: Certain services, like featured job posts or premium profiles, may require payment. All fees are quoted in ZWL or USD and must be paid fully and on time via accepted methods (e.g., PayFast, Stripe).
  • Billing: Provide accurate billing information. You authorize recurring charges for subscriptions.
  • Refunds: Fees are non-refundable except as required by the Consumer Protection Act (e.g., within 7 days for cooling-off periods on digital services). Late payments may incur a 5% fee after 30 days.
  • Taxes: You are responsible for any applicable taxes (e.g., VAT under the Value Added Tax Act [Chapter 23:12]).

5. Disclaimer & Limitation of Liability

  • As-Is Basis: The Site and Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
  • No Guarantees: We make no representations regarding the accuracy, reliability, completeness, or timeliness of content. Outcomes of using the Services, including employment results or job matches, are not guaranteed.
  • Third-Party Content: ZimNGOs.Org is not liable for content published by employers, recruiters, or other users on the Site, including job postings, descriptions, requirements, or any associated materials. We do not verify, endorse, or guarantee the accuracy, legality, or suitability of such content. Users interact with third-party content at their own risk, and ZimNGOs.Org disclaims all responsibility for any errors, omissions, or harms arising from it (e.g., misleading job ads or discriminatory postings). We may remove such content at our discretion but are under no obligation to monitor or correct it.
  • Limitation: To the maximum extent permitted by Zimbabwean law (e.g., ECTA Section 20), ZimNGOs.Org, its affiliates, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages (e.g., lost profits, data loss) arising from your use of the Site or Services. Total liability is limited to fees paid by you in the preceding 12 months.

6. Termination

  • By You: You may close your account anytime via Site settings, subject to any outstanding payments.
  • By Us: We may suspend or terminate your access immediately if you violate these Terms, with notice where practicable (e.g., 7 days for minor issues). Appeals can be submitted to support@zimngos.org.
  • Effects: Upon termination, your right to use the Site ends, but obligations like payment, confidentiality, and intellectual property survive.

7. Governing Law

  • Applicable Law: These Terms are governed by the laws of Zimbabwe, without regard to conflict of law provisions.
  • Disputes: Any disputes arising from these Terms or Site use will be submitted exclusively to the competent courts in Harare, Zimbabwe.
  • Alternative Resolution: For non-consumer disputes, we encourage binding arbitration under the Arbitration Act [Chapter 7:15] before litigation. Class actions are waived to the extent permitted by law.

8. Changes to Terms

We may update these Terms periodically to reflect changes in our Services or legal requirements.

  • Updated Terms will be posted here with the new "Last Updated" date. We will notify registered users via email for major changes.
  • Your continued use after updates constitutes acceptance.

9. Privacy & Data Protection

By using the Site, you agree to our Privacy Policy, which details how we collect, use, and protect your data in compliance with the DPA.

  • We do not guarantee the verification of job postings or employers—conduct due diligence.

11. Indemnification

You agree to indemnify, defend, and hold harmless ZimNGOs.Org, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Site or Services;
  • Violation of these Terms;
  • Submission of content or your conduct on the Site;
  • Any infringement of third-party rights by your content or actions.
